Commission TOS

Before you request a commission, ensure the content is within my guidelines:

-I accept PayPal, Stripe, and credit/debit (in USD)!

Please contact us on social media or our business email (contact@creaturiam.com) if you are having trouble with payment through our accepted payment options.

-I do not draw NSFW or heavy gore

At this time I do not do any sensitive media, meaning no sexual art, fetish art, or heavy gore. Blood, wounds, and etc. are fine! Just ask if you aren't sure what I would be comfortable with!

-I will not do any content the depicts or glorifies; sexual assault or harassment, rape, pedophilia, zoophilia, incest, and etc.

Any requests for art that violate this rule may result in an immediate and permanent blacklisting of my services, contact, or content.

-I will not do any work with offensive content, such as racism, xenophobia, homophobia, transphobia, sexism, ableism and etc.

NOTE: This includes any content that is culturally appropriative such as feathered headresses, feathers behind the ears/in hair, etc.

If your character does not currently comply with this we can change the placement/remove feathers and/or other accessories. If you do not comply to this your commission request will be denied.

If the character in question is very heavily/obviously offensive or appropriative I have the right to deny your commission request regardless of willingness to change the design.

Terms of Service:

-You must provide a clear reference of some kind for accurate work.

Any photos or references that are heavily shaded, grainy, extremely low quality, not showing full markings, and etc cannot be accepted unless otherwise discussed. I have accepted it in the past, but it takes a lot of extra time and effort to understand the design, colors, and patterns with only words or with a heavily shaded or poor quality reference.

-Payment request will be sent via invoice.

All custom commissions will be paid with an invoice that will outline my Terms of Service.

-After you submit the form, I will give you the total price quote

Please don't be afraid to let me know if you can't pay or would like to opt out! Please send me a message confirming you would like to commission me after I have agreed I can do what you are looking for!

-You must pay in full first.

After I receive payment I can begin to work on your commission.

-You may NOT use my work for commercial purposes.

Unless explicit permission is given otherwise you cannot sell or reproduce my work, meaning do not sell T-shirts, prints, or profit of my art in any way.

-You can not claim the artwork is made by you.

Otherwise it is your artwork for personal use and you may do with it as you please (within personal use) as long as it is not being used commercially (unless you were given explicit permission by me for it to be used commercially).

-Any part or iteration of my artwork or character designs/adoptables may not be exchanged, bought, sold, or otherwise used for or directly associated with Non-fungible Tokens (NFTs), cryptocurrency, or the blockchain.

I do not allow my work to in any way associate with the blockchain due to ethical and environmental consequences.

-You may only request a refund on work that has not been started.

I you do not know if I've started your commission please ask. If I have not started your commission you may request a refund and/or I may authorize a refund at my discretion.

-There is no set deadline unless we discuss it and you pay a fee.

You may request a rushed deadline for a fee, if the deadline is in a month or so I will usually do the work by that time free of charge, but you must give me notice. My turnaround is usually anywhere from 2 weeks to 2 months, but that is not a set timeline.

-If the scope of the project changes dramatically from what was originally agreed upon and paid for, it may incur a fee.

You may request small changes to a project as long as they do not change dramatically from what was originally agreed upon and paid for. For example, if you pay for a bust painting of your pet, you are not entitled to change the scope of the project to a full body piece. Any drastic changes to the scope of the project paid for must be agreed upon and incur a fee at my discretion.

-You may request revisions free of charge for up to 2 weeks after completion.

You may request changes within this time frame as long as it adheres to my other Terms of Service. After this timeframe is over you may have to pay a fee for changes.

-You are entitled to a full refund if I cannot complete your work in 170 days unless a separate date was agreed upon before payment.

You are entitled to a refund if I cannot complete your work without 170 days with no exceptions unless we agreed upon a later date before payment. This protects you as a buyer and can give you confidence I will always deliver on my services or your money back. This does not apply to completed orders or orders you wish to have a revision, I do not do any revisions after 2 weeks of completion.

-I have the right to stop your commission at any time, if applicable you will receive a full refund.

While unlikely and uncommon, if I cannot complete your work you will get a full refund for that commission even if it has already been started. You will be contacted immediately if I need to opt out of doing your work. If your commission takes a long time to be completed that does NOT count as failure to complete your work.

-I have the right to use my work to share publicly including on social media and in my portfolio.

Unless specified otherwise or an agreement is made, I am allowed to share my artwork and designs including on social media and in my portfolio.

-My commission/artwork cannot be altered without my permission.

If you would like my artwork to be altered in any way please ask permission before doing so.

You acknowledge you have read and agree to all my Terms of Service when you commission or purchase from me.
